Waiver and Liability Release, Copyright Assignment & Infringement Liability, Photo and Video Release

PLEASE READ THIS DOCUMENT CAREFULLY. BY AGREEING TO THE TERMS AND CONDITIONS, YOU ARE GIVING UP CERTAIN LEGAL RIGHTS.

I: WAIVER AND LIABILITY RELEASE

This Waiver and Release of Liability (the "Agreement") is entered into by the undersigned participant ("Participant" or "I") or, if the Participant is a minor, by the Participant's parent or legal guardian, in favor of Magg Designs LLC DBA The Engrave Lab, its owners, officers, employees, instructors, and agents (collectively, "The Engrave Lab").

In consideration for being permitted to participate in workshops and use the equipment and facilities at The Engrave Lab, I hereby acknowledge and agree to the following:

1. Acknowledgment and Assumption of Risks:
I understand that participation in workshops at The Engrave Lab involves activities that may be hazardous. I acknowledge that I am voluntarily participating in these activities with full knowledge of the inherent risks, which include:

  • Laser Engravers: Risk of severe eye injury, including permanent blindness. Risk of burns from contact with the laser beam or heated materials.
  • UV Printers: Exposure to toxic resin and inks before they are fully cured. Skin contact may cause irritation. Ingestion is hazardous.
  • Harmful Fumes: Inhalation of fumes, vapors, or fine particles generated during processes.
  • General Workshop Risks: Slips, trips, falls, and improper use of equipment.

Participant willingly assume all such risks, both known and unknown, even if arising from the negligence of The Engrave Lab or others.

2. Personal Protective Equipment (PPE):
Participant understands that they are required to use all provided safety equipment, including safety glasses designed for laser protection, at all times when instructed.

3. Release and Waiver of Liability:
Participant hereby expressly waive and release any and all claims against The Engrave Lab on account of injury, disability, death, or property damage arising out of participation.

If the participant is under 18: Ages 7-12 require a guardian present. Ages 13-18 require a guardian to provide signed consent by checking the box below.

4. Indemnification:
Participant agrees to indemnify and hold harmless The Engrave Lab from any claims, damages, liabilities, and expenses arising out of participation.

II: COPYRIGHT ASSIGNMENT AND INFRINGEMENT LIABILITY

Participant hereby irrevocably assigns to Magg Designs LLC DBA The Engrave Lab all rights, title, and interest in and to any creations, designs, and products created during the workshop. The Engrave Lab shall have the exclusive right to use or display these Creations.

Copyright & Trademark Infringement: Participant acknowledges they are solely responsible for ensuring personal designs or artwork do not infringe upon third-party intellectual property rights. The Engrave Lab is not liable for any copyright or trademark infringement committed by the Participant. Participant agrees to assume all risks and indemnify The Engrave Lab against any claims arising from alleged IP violations.

III: PHOTO AND VIDEO RELEASE

Participant grants The Engrave Lab permission to capture, use, reproduce, and publish participant's image and voice in media (including social media) for promotional purposes without compensation.

Participant has read this waiver. Participant fully understands its terms, and understands they are giving up substantial rights. Participant agrees freely and voluntarily.
